Canadian Real Property Law and Real Estate Ethics

Subject Description
This subject provides a practical overview of the law of real property, including the nature of ownership interests in land, land title registration, mortgage law, commercial and residential tenancies and condominium law.   In addition, it will examine the fundamental principles of contract and tort law as they relate to real property ownership.  It will also address the legal and ethical guidelines governing real estate professionals.

This is a credit subject applicable towards the Real Property Administration Diploma Program offered through the School of Legal and Public Administration.

This is a credit subject applicable towards the CRA and AACI Designations with the Appraisal Institute of Canada.

Learning Outcomes
Upon successful completion of this subject the student will be able to:

1. Describe various aspects of the Canadian legal system, including its structure, organization, division of powers, sources of law, and the regulation of the real estate industry within that system.     
2. Distinguish between different types of estates, interests in land less than estates, and options for co-ownership of land.
3. Apply basic contract law principles regarding the formation, validity, interpretation, and termination of  contracts, with a focus on real estate contracts.        
4. Identify  remedies  granted by the courts to resolve contractual disputes.   
5. Explain the land titles registration system and the role of the real estate agent in real property transactions.
6. Describe the responsibilities of land owners and occupiers under different areas of  tort law.
7. Recognize various types of mortgages, key legislation affecting mortgages, and highlights of lenders' remedies in the event of default.
8. Discuss highlights of the law regarding commercial and residential tenancies.
9. Summarize basic legal principles governing the creation, operation and transfer of condominiums .
10. Identify key legal and ethical standards regulating real estate professionals.

Camera Use and Recordings - Synchronous (Live) Classes
Synchronous (live) classes may be delivered in person, in a Flexible Learning space, or online through a Seneca web conferencing platform such as MS Teams or Zoom. Flexible Learning spaces are equipped with cameras, microphones, monitors and speakers that capture and stream instructor and student interactions, providing an in-person experience for students choosing to study online.

Students joining a live class online may be required to have a working camera in order to participate, or for certain activities (e.g. group work, assessments), and high-speed broadband access (e.g. Cable, DSL) is highly recommended. In the event students encounter circumstances that impact their ability to join the platform with their camera on, they should reach out to the professor to discuss. Live classes may be recorded and made available to students to support access to course content and promote student learning and success.
